Victory! Well, some form of victory, anyway. After compelling testimony from California couples who are denied the freedom to marry, Federal District Judge Vaughn Walker ruled today that Proposition 8 is unconstitutional.
The case will now move to the Court of Appeals.
We owe Governor Arnold Schwarzenegger and Attorney General Jerry Brown a great deal of gratitude for their unprecedented decision not to defend this discriminatory measure, leaving only Andrew Pugno’s anti-LGBT extremist group to defend the case.
A measure to repeal Proposition 8, the anti-gay marriage initiative, has failed to qualify for the November ballot here in California.
John Henning, who heads a group that sponsored the repeal effort, declined to say how many signatures had been gathered since the all-volunteer campaign got underway in late November. He said 694,000 valid signatures were required by Monday.
This does not mean we are in the clear yet, so stay tuned and be aware this is still a current issue in our fight for equality!
its about time. im ashamed that in a country so quick to tout its equality and justice, that not everyone can marry the person they love! we still have so far to go on an issue that shouldnt even be an issue.

I’m sorry but marriage should not be left to the courts to decide. If the Churches wanna challenge it then let them but government has no business in marrage. Marriage is between two individuals doesn’t matter if it is man and woman, man and man, or woman and woman. Marriage is just vows between two people.
When the majority tries to take away rights from a minority through votes and legislation, the courts are where law is settled. Equal protection under the law. 14th amendment. Look it up. I’d rather no government say at all in lots of things, but mob rules makes courts the only hope of minority rights and ensuring due process.
dragonfire, if you beleive this then why are you not complaining that couples have to apply for marriage license at city clerk’s offices or that DOMA was passed, etc. Also, if the government has no business in marriage, then why all tax and other benifits? Soon you may find that marriage is a lot more than vows. Unfourtunately churches don’t generally teach equality.
This is good news. As someone who lives in a state where marriage is equal for EVERYONE, I am glad to see that such a progressive state as CA is also seeing the light. People will give all kinds of bullshit excuses as to why it’s wrong (my marriage to my husband hasn’t destroyed the marriages of my straight friends nor has it ruined any families). In the end it all points to needless continued discrimination based on old stereotypes and unfounded fears. I truly hope that Prop 8 continues to be seen as unconstitutional. I know the “people” of California voted against equal marriage but sometimes the “people” don’t know what’s best for them. Sometimes it takes another set of eyes to see put things right. I am now in the middle of planning our ceremony: choosing food for the reception, designing a wedding cake, choosing flowers. It’s a challenge but it’s also fun. I truly hope that the men and women of CA get to have the same experiences in planning their weddings. They deserve the same happiness that everyone else gets when getting married.
So, am I alone in finding it disturbing that no matter what the case – a lone judge can overturn the votes of 7 million people? I think that a grave injustice has been done to the Constitution today.
Just hypothetically, What if 7 million voters decided that only individuals of a particular ethnicity are allowed to own property? What if a lone Judge decided that the law violated rights guaranteed by the US Constitution? Would you still find his action disturbing?
The only “grave injustice” involved is that inflicted by the 7 million on those who should have the same rights in a civil society as others but are denied due to no other reason than pure HATE!

After going through that first devastation of rights being taken away, I’m ready for change. I live in Hawaii and our governor Lingle just made sure that gay couples could not have the same rights as everyone else in the state. I’m sick and tired of all of this discrimination and then of course the fact that they try to cover their asses after making such terrible decisions. They can keep their crappy money and politics. I want real change, love and peace. Because people everywhere have already been offended and slapped around enough. I know I have.

Leaving the legal questions aside, I’m constantly amazed of how a group of people who set themselves up as being different, want to also be the same. We are not the same. We are distinctly not. So what is this obsession with acceptance?
We preach diversity like apostles. But only the diversity that doesn’t DIFFER. Only the diversity that accepts a set of ideas that tells those that differ to shut-up. Only the diversity of ideas that props up one side. Hence we left with a lop-sided tent that makes everyone uncomfortable and unhappy.
We need to move away from the dogma that those who have a differing view are bigots. That those who love their religion, hate gays. To be understood requires us to understand. Painting them into a corner, is not how to get them to understand us.
Good for California on making some progression. I’m from Maine and I’m gay. Last election we had a vote on gay marriage in Maine and it looked like we were gonna win, but all the old racist,sexist, religious and homophobic farts that unfortunately reside in Maine turned it down. This also brought out my family’s true feelings about gays… and I have never came out to anyone and I guess I won’t be for their sake.. I guess this is my first time coming out and of all places on a gay porn star’s website (something to remember I suppose lol). But I am glad I did here because Brent seems like such a nice guy, hes beautiful and I think we could get a long really well
